2.2 Project Timeline
Estimated timelines provided in our service descriptions are indicative. Actual delivery dates will be confirmed in the project agreement. Delays caused by client-side factors (delayed feedback, content provision, third-party dependencies) may extend the timeline proportionally.
2.3 Intellectual Property
Upon full payment, all custom code, designs, and documentation created specifically for your project are transferred to your ownership. LumvexaCreativeLab retains the right to use general methodologies, frameworks, and non-proprietary code patterns developed during the engagement.
2.4 Client Responsibilities
Clients are responsible for providing timely feedback, necessary content (text, images, branding assets), access credentials for hosting and third-party services, and approval at agreed milestone points.
2.5 Limitation of Liability
LumvexaCreativeLab's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
2.6 Governing Law
These terms are governed by the laws of the Portuguese Republic. Any disputes shall be resolved in the courts of Lisbon, Portugal.
4. Refund Policy
LumvexaCreativeLab, located at Estrada do Guincho, Condomínio Malveira-Guincho, Lote 37, Casa D, 2755-140 Alcabideche, Portugal, aims to deliver high-quality web development services. We understand that circumstances may change, and we have established the following refund guidelines.
4.1 Cancellation Before Work Begins
If you cancel a project before any work has commenced, you are entitled to a full refund of any advance payment within 14 business days.
4.2 Cancellation During Active Project
If a project is cancelled after work has begun, you will be refunded for the portion of work not yet completed. Work already delivered and accepted will be invoiced at the agreed rate. Cancellation must be communicated in writing via email to [email protected].
4.3 Milestone-Based Billing
Projects structured around milestones are billed upon completion and approval of each milestone. If a project is terminated between milestones, payment is due only for the last completed and approved milestone. Any deposits for upcoming milestones will be refunded.
4.4 Dissatisfaction with Deliverables
If you are dissatisfied with delivered work, please notify us within 7 days of delivery with specific details regarding the issue. We will review the feedback and, at our discretion, provide revisions at no additional cost or offer a partial refund for the affected deliverable.
4.5 Maintenance and Subscription Services
Monthly maintenance and support subscriptions can be cancelled at any time with 30 days' written notice. No refund is provided for the current billing period, but no further charges will be applied after the notice period.
4.6 Processing Refunds
Approved refunds are processed within 14 business days using the original payment method. If the original payment method is unavailable, we will arrange an alternative refund method by mutual agreement.
